Terms of Service

1. Scope
These Terms of Service govern your use of the bestdesq web application (bestdesq.app), a service provided by bestdesq | websolutions, Axel Wüstemann. By registering you accept these terms.
2. Provider
The service is provided by bestdesq | websolutions, Axel Wüstemann, Virchowstraße 13, 19055 Schwerin, Germany. Contact: info@bestdesq.de.
3. Registration and account
Using bestdesq requires registration with a valid email address. You are responsible for the security of your credentials. Each registration creates a tenant with its own subdomain. The subdomain is permanent and cannot be changed afterwards.
4. Free trial
After registration you receive 30 days of free access to the full feature set. No payment method is required during the trial. The trial ends automatically — there is no automatic conversion to a paid subscription.
5. Subscription and billing
bestdesq offers monthly subscriptions:
- Solo (1 user): flat €9 / month (VAT-exempt under § 19 German VAT Act)
- Team (2+ users): role-based per user, depending on the assigned functional role:
- Maker roles (Creative, Project management): €9 / user / month
- Pro roles (Management, Sales, Finance): €19 / user / month
Subscriptions renew automatically for one month unless cancelled before the end of the current billing period. Price changes are announced by email with 30 days' notice.
Billing is pro-rata: changes to the number of users or their role assignments are settled proportionally at the next billing date.
6. Payment processing
Payments are processed by our partner Paddle.com (Paddle Payments Ltd.), who acts as Merchant of Record. Paddle issues invoices, collects payments, and is your contractual partner for all payment-related matters. Paddle's terms are available at paddle.com/legal/terms.
7. Cancellation
You can cancel your subscription at any time via account settings or the Paddle customer portal. Cancellation takes effect at the end of the current billing period. Access remains active until the end of the paid period. There is no minimum contract duration.
8. Your data and content
All data you enter into bestdesq (projects, tasks, invoices, contacts, time entries, files, wiki content) belongs to you. You can export your data at any time via settings. On cancellation or account deletion, your data is handled in accordance with our Privacy Policy. Invoice data is subject to statutory retention periods.
9. Availability
We aim for high availability but cannot guarantee uninterrupted service. Planned maintenance will be announced in advance where possible. We accept no liability for outages caused by force majeure, third-party service disruptions, or necessary maintenance work.
10. Liability
We are fully liable for intent and gross negligence. For slight negligence, liability is limited to breaches of material contractual obligations and capped at the typically foreseeable damage. Liability for data loss is limited to the recovery effort that would have arisen with regular backups. Liability under product liability law remains unaffected.
11. Suspension and termination by the provider
We reserve the right to suspend or terminate accounts in the event of abuse or breaches of these terms. In such cases the user will be notified in advance and given the opportunity to export their data, unless legal reasons prevent this.
12. Changes to these terms
We may update these terms with reasonable notice. Material changes will be announced by email at least 30 days before they take effect. If you do not agree to the updated terms, you may terminate your subscription effective on the date the changes come into force.
13. Governing law
German law applies. Consumers additionally benefit from the mandatory consumer protection provisions of their country of habitual residence. For merchants, the place of jurisdiction is Schwerin, Germany.
